Terms and Conditions

RENTAL GENERAL TERMS AND CONDITIONS.

  1. The rental agreement is established between the Client and the Owner.
  2. Information Request: information on the availability of a property can be requested via our website, e-mail (info@petrasudestcharme.it) and telephone stating your name, the period of stay desired, the number of persons, the telephone number and your e-mail address. Petra srl will reply within a few hours.
  3. Booking the accommodation: if you wish to book the accommodation, our operators will send you the booking form (or rental contract) by e-mail. In the following 2 days (reduced to 1 day during the high season) it will be possible to confirm the booking by sending: – the booking form duly filled in and signed; – a copy of the identity card; – a copy of the receipt of the deposit payment, equal to 30% of the total rental price of the stay.
    The remaining 70% to be paid as the balance of the rental price must be settled 30 days before the arrival date. Different payment methods must be agreed and expressly approved in advance. For bookings made less than 30 days before the start of the stay, clients must pay the full amount at the time of booking, in a single installment.
 Upon receipt of the balance Petra srl will send to clients by e-mail all instructions about how to reach the property and the contact details of the person who will check in.
  4. Paying the stay: payments must be made by bank transfer (IBAN and bank details of Petra srl will be communicated by email upon confirmation of the booking). Exceptionally, cash payments can also be accepted if requested in advance;
  5. Cancel Booking: in accordance with art.32 of the Tourism Code, this contract does not provide for the right of withdrawal as per Law Decree dated September 6th 2005 No. 206 for contracts concluded at a distance. However, a cancellation of the booking is permitted, but must be received on working days (Monday to Friday from 09.00 to 19.00) prior to arrival and does not include the day of arrival and the day of the communication itself. Notice of cancellation must be received in writing at info@petrasudestcharme.it. In case of cancellation of the reservation, the customer will be charged a penalty amount as listed below: – 30% of the total amount of the stay for cancellations made up to 60 days before arrival; – 60% of the total amount of the stay for cancellations made from 59 to 30 days before arrival; – 100% of the total amount of the stay for cancellations made from 29 days before arrival. The deposit is never refundable. Petra srl does not offer cancellation insurance, we therefore strongly recommend that you take out insurance to cover the cost of your stay, in the event of circumstances that may prevent you from enjoying it.
 For rentals of more than 4 weeks the payment and cancellation terms as well as the Security Deposit may be subject to variations which will be communicated at the time of booking with the corresponding documentation.
  1. Check-In and Check-Out: Saturday usually is the arrival and departure day, unless a different day has been agreed. The expected arrival times are between 4.00 and 7 .00 PM. We kindly ask our guests to inform us of their arrival time at least one week before the beginning of their stay so that the owner or his representative can be on site to wait for the client and facilitate their arrival at the property. Any change in the arrival date and time must be communicated to Petra srl as soon as possible by e-mail or telephone. Upon arrival, clients are requested to provide the booking confirmation form and an identification document (passport or identity card) to the owner or his representative for the registration of attendance as required by the Italian law. In the absence of these documents the access to the property will be at the owner’s discretion. Departure from the property must take place in the morning before 10.00 a.m., allowing access to the owner or his representative to check the state of the property and the cleaning staff to tidy the house at least one hour before the communicated departure time. The time of departure must always be communicated at least 12 hours in advance to the owner or the property representative.

     

  2. Security deposit: the security deposit must be paid by cash in Euro upon arrival (a cheque can also be accepted if previously agreed). The deposit will be returned to the client on departure after checking the state of the property and after deducting any damage caused and any additional expenses not included in the rental price (e.g. final cleaning or excess consumption expenses where expressly indicated). The owner is entitled to deny the entry to any client who has not paid the security deposit. If a client moves out earlier, or if the departure takes place at a different time from the agreed one, the owner or his representative are entitled to return the deposit by bank transfer (deducting consumption and possible damages) only after having checked the inventory of the accommodation. In the case of a claim between the client and the owner for any damage caused to the property or its furnishings during the stay, where there is a need to repair the damage, with consequent payment by invoice, the owner or his representative are entitled to return the deposit by deducting the amount of the invoice and attaching a copy to the client.
  1. Client behaviour: the client signing the booking form is responsible for the correct and respectful behaviour of the hosted group/family. By collecting the property keys, the client will become the keeper of the property, its furnishings and anything else present in it and will have to diligently keep the property. Guests are kindly requested to observe the behavioural norms in use in our country and show the utmost respect towards the owner and the structure. It is therefore absolutely forbidden to move furniture inside the home, take furniture and furnishings inside or outside the home and/or use them for any other purpose than their intended ones. – In the event that a guest does not respect the rules of good behaviour and these are the cause of damage caused to the structure or furnishings contained therein or supplies outside the home in relation to the garden and swimming pool, the owner will have the right, at its sole discretion, to consider cancelled the rental agreement by verbal communication to the guest and via written form to the agency, asking for the immediate removal of the customer from the property with the right to appeal to the public authorities. 
  1. Number of Guests: only the people listed on the booking form can access and use the property. Petra srl will have to be informed and will have to approve 
    any replacement or increase of guests that occur within the property during the stay, 
    agreeing with the owner that he can decide to charge any further cost.
  1. Equipment and property status: the property will be provided clean and complete with bed, bathroom and kitchen linen. Necessary crockery will be provided for the number of people to be hosted. At the end of the stay period the house must be left in good condition, the waste will be stored in the indicated containers, the dishes of the kitchen will have to be cleaned and the refrigerator will have to be left empty. If guests do not dispose of the waste from the property, the owner or his or her delegate may request a surcharge for this service. The kitchen should be left clean and tidy. If, for any reason, even in time, guests will not be able to clean the kitchen and furnishings before their departure, the owner will be entitled to request a surcharge for cleaning it.
  1. Animals: pets are only allowed on request.
  2. Maintenance and Extraordinary Interventions: In the event of maintenance or necessary extra work for the smooth running of the holiday, customers may under no circumstances be able to prohibit the access of owners or managers of facilities within the 
    property or the dwelling. It is understood that the owners will always give prior notice and require the
    presence of the guests themselves, provided that where the guests cannot be present 
    during the works, the owners or their agents will still be able to enter the houses, if 
    necessary, to carry out any repair work. 
  1. Responsibilities and Complaints: the published description corresponds to the factual status of the property. Having tried to provide the best possible description of the structure itself with photos, videos, maps and detailed information, Petra srl does not hold herself responsible if a customer who has correctly viewed the website does not find the property of his own taste upon arrival.

    –
    Petra srl is not held liable for any kind of damage or loss of personal belongings suffered during the stay.

    – Any complaint must be made during the stay. No complaint submitted at a later date will be considered. No repayment will be due to the customers who, in the event of discomfort or problems, leave the property without prior written communication to Petra srl, or decide to leave the property earlier than agreed without valid reasons or serious hardships or without having given an explanation and written justification to Petra srl in advance, or without having carefully consulted the website and have therefore found unsuitable conditions for them   or just leave the property without having given to Petra srl  the chance to verify the motivation of the complaint.

    – Petra srl is also not held liable if a customer has not carefully consulted the website in all its parts as requested and signed in the contract while booking. Moreover, no reimbursement will be due to customers who will be removed from the facilities at the request of the property for lack of communication concerning overpopulation or the presence of animals (the number of overpopulation and the presence of animals must always be communicated to and agreed with Petra srl) or in the absence of payment of the security deposit required upon arrival.

    – Petra srl declines any responsibility for any inconveniences caused by third parties or external events not directly attributable to the owner of the structure or his staff, such as, for example, atmospheric events, local fauna, seasonal phenomena, maintenance of public roads or renovations of buildings and similar works in the vicinity of rented properties.

  1. Privacy Statement: during the booking process, some data concerning guests will be required and processed (including by electronic means) exclusively to provide the requested services (e. g.: communication to owners for the organization of the reception of guests in their holiday facility). The data will be available to external parties (such as owners of occupied buildings and external consultants) and the people who manage the bookings. The information will be stored on our servers, where we and any technical maintenance personnel may have access. Guests have the right to know their data in our possession and to exercise the different rights regarding their use (rectification, updating, erasure, etc.) defined by the Law Decree No 196/2003 within the limits and under the conditions laid down in Articles 8, 9 and 10 of that legislative decree. If the host opposes the processing of his or her data, we will not be able to provide our service.

PERSONAL DATA PRIVACY (Law Decree No. 196 dated June 30th, 2003)

Petra srl, in accordance with Article 13 of the Law Decree No. 196/2003 and subsequent amendments (“Privacy Code”) informs you that the data provided by you (hereafter “Data”) directly or through third parties, may be subject to collection, recording, organization, storage, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, diffusion, cancellation and destruction (the “Processing”). The Data will be processed for statistical and fiscal accounting purposes, for the fulfillment of contracts of sale of the goods and services provided by Petra srl or to fulfill, before the conclusion of such contracts, your specific requests and for the promotion of such goods and services, to improve them and to send you, also by e-mail, commercial information about such products and services. In relation to the aforementioned purposes, the Data will be processed by means of computer and/or telematic tools, or on paper, and in any case by means suitable to guarantee compliance with the requirements of confidentiality and security measures provided for by the Privacy Code. The computer systems and software will be configured in such a way as to minimize the use of personal and identification data that are not necessary for the purposes of processing indicated above. While visiting the site, we may use “cookies” in order to allow us to recognize you when you return to the site and to make your registration and any other procedures easier for you. Cookies are small text files that are stored by your browser on your hard drive. The cookies we use will not provide us with any personal information about you. Ms. Stefania Urso is the Data Controller on behalf of PETRA srl. The Data may be communicated to professionals, external consultants, companies that provide IT services, advertising companies, business partners, third parties that Petra srl may contact in order to pursue the above purposes and to the legitimate recipients of any communications according to applicable laws and regulations. Moreover, Data may also be communicated to companies controlled by and/or connected to Petra srl, as service providers and data processors. Data may be transferred abroad, but in any case within the European Union. The Data will not under any circumstances be disseminated or communicated to third parties for the purpose of their promotional activities. Petra srl also informs you that, in relation to the aforesaid Processing, you may exercise the rights provided for by art. 7 of the Privacy Code, including, in particular, the right to know your registered Data, to obtain their updating, rectification or integration, to block Data processed in violation of the law, by sending a written communication to Petra srl via Vecchia Castiglione, 71 – 73030 Diso (LE), Italy.

Petra srl informs you that, pursuant to the Privacy Code, your consent to the Processing of Data for the marketing and advertising purposes indicated above is required. Consent is optional, but refusal would make it impossible to Petra srl to carry out the above mentioned promotional activities.
